1. Purpose
These Terms of Service govern access to and use of the Spuma application, available at spuma.app (hereinafter “the Service”).
Spuma is an educational and calculation tool intended for people who practise cold-process saponification (artisan soapmaking). It allows formulas to be calculated, provides access to a library of referenced ingredients, and allows recipes to be saved.
By accessing the Service, the User acknowledges having read these Terms of Service and accepts them without reservation.
2. Limitation of liability — Calculations and formulations
Cold-process saponification involves handling hazardous chemicals (sodium hydroxide NaOH or potassium hydroxide KOH) that can cause severe burns and require suitable personal protective equipment.
The User expressly acknowledges that:
- Spuma is no substitute for practical training in artisan soapmaking or for professional advice.
- The saponification values (SAP), iodine values, properties and recommendations displayed are approximations taken from public sources and may vary from one batch of raw materials to another.
- The final check of the safety, quality, pH, cure and compliance of the soap produced is entirely the responsibility of the User.
- Spuma cannot be held liable for any bodily injury, property damage or commercial loss resulting from the use of the information or calculations provided by the Service.
- The making available on the market, whether in return for payment or free of charge in the course of a commercial activity, of soaps produced with the help of Spuma falls under Regulation (EC) No 1223/2009 on cosmetic products (or the equivalent regulations of the country of sale) — Spuma does not guarantee the regulatory compliance of finished products. The CPNP notification, the product information file (PIF) and the safety assessment by a person meeting the conditions of Article 10(2) remain the sole responsibility of the responsible person within the meaning of Article 4 of the Regulation.
3. User account
Registration for the Service is free of charge (Free plan) and provides cloud synchronisation of recipes (up to 3 recipes on the free plan). Registration is reserved for people of legal age.
The User undertakes to:
- Provide accurate information when creating their account (email, name).
- Maintain the confidentiality of their login credentials (password or Google OAuth account).
- Inform Spuma without delay of any unauthorised use of their account.
Spuma reserves the right to suspend or terminate any account in the event of a breach of these Terms of Service, or of any abusive or fraudulent use or use contrary to public policy.
4. Pricing plans
Spuma offers several plans:
- Free: free of charge, 3 cloud recipes maximum, access to the calculator and the library.
- Pro: coming soon — extended features (100 recipes, tags, version history, notes, basic product label).
- Premium: coming soon — professional workshop tools (unlimited recipes, material batches + costs, production management, pro labels, private library).
The prices and terms of the paid plans will be set out when they are launched. Any subscription will be subject to additional Special Terms of Sale.
5. Intellectual property
All elements of the Service (interface, code, editorial content, database of sourced ingredients, illustrations, visual identity) are the exclusive property of the publisher of Spuma or of the rights holders who have granted the publisher a licence.
The User retains full ownership of their own recipes entered in the Service. Spuma undertakes not to exploit Users’ personal content without their explicit consent (see Privacy Policy).
6. Availability of the Service
Spuma is provided “as is”, without any guarantee of continuous availability. Service interruptions may occur for maintenance, updates, or for reasons beyond Spuma’s control (hosting provider outage, network incident, etc.).
No compensation will be due in the event of a temporary interruption of the Service.
7. Termination
The User may delete their account at any time from the My Account screen → Delete my account button. Deletion results in the permanent erasure of the associated personal data and recipes, in accordance with the Privacy Policy.
8. Changes to the Terms of Service
Spuma reserves the right to amend these Terms of Service at any time. Users will be informed of substantial changes by email or by notification in the application. Continued use of the Service after a change constitutes acceptance of the new Terms of Service.
9. Governing law and jurisdiction
These Terms of Service are governed by French law. Any dispute relating to their interpretation or performance falls within the exclusive jurisdiction of the competent French courts, subject to the mandatory public-policy provisions applicable to consumers.
